Terms and Conditions

1. Agreement
By making a booking with Funchal Tours, operated by Potential Green LDA (NIF: PT518205061), you confirm that you have read, understood, and agreed to these Terms and Conditions. This agreement is between the client and Potential Green LDA, trading as Funchal Tours, registered under RNAAT n.º 970/2024.
2. Booking
We recommend booking 2 to 3 months in advance to secure your preferred date and tour. All bookings are subject to availability.
A non-refundable deposit of 50% of the total tour cost is required to confirm your booking. The remaining balance is due on the first day of the tour, payable by bank transfer, credit card, or cash.
By completing your booking you agree to these terms on behalf of all members of your party.
3. Pricing
Tour prices are quoted per group, not per person, unless stated otherwise. Standard full-day tours run approximately 7 to 8 hours. Time beyond this is charged at 100 EUR per hour.
All prices include: private guided service, transportation by private vehicle, and any entrance fees specified in your booking. Meals, personal expenses, and gratuities are not included unless stated.
Funchal Tours reserves the right to revise prices at any time before a booking is confirmed. Once your deposit is received, your price is fixed.
4. Services
Funchal Tours provides private guided tours in Madeira, including levada walks, mountain and interior exploration, Funchal city tours, and culinary experiences. Our guides have local knowledge and operate in small, private groups.
We do not provide high-adventure guiding, extreme sports, or any services not explicitly listed in your booking confirmation.
Funchal Tours is an authorised tourism operator registered under RNAAT n.º 970/2024 and governed by Portuguese tourism law.
5. Changes and cancellations
Cancellation by the client
All cancellations must be submitted in writing to hi@go.funchaltours.com. Refund eligibility is determined by how much notice is given before the scheduled tour date:

Exceptional circumstances are assessed individually. We always aim to find a fair resolution.
Rescheduling
Rescheduling is permitted once per booking, provided the request is made at least 72 hours before the original tour date and subject to availability on the new date. A second reschedule is not available; the original cancellation policy will apply.
Cancellation by Funchal Tours
Funchal Tours reserves the right to cancel or modify a tour due to unsafe weather conditions, force majeure events, or circumstances beyond our reasonable control. In such cases, we will offer a full refund or an alternative date. We are not liable for any additional costs you incur as a result of such a cancellation (for example, accommodation or flights).
6. Client responsibilities
Clients are responsible for their own physical fitness and health. You must inform us before booking of any medical conditions, mobility limitations, or dietary requirements that may affect your ability to participate safely.
Clients must arrive at the agreed meeting point on time. Significant delays (more than 30 minutes without notice) may result in the tour starting late or being cancelled without refund.
Appropriate footwear and clothing for outdoor activity is required on walking tours. Our guide may refuse to continue a tour if a client's behaviour or attire poses a safety risk to the group.
All members of your party must follow the guide's safety instructions at all times.
7. Liability
Funchal Tours, operated by Potential Green LDA, carries the mandatory civil liability insurance required under Portuguese tourism law.
Our liability to you is limited to the amount paid for the tour. We are not liable for any indirect or consequential loss, including travel, accommodation, or other expenses, arising from a tour cancellation or modification.
Clients participate in outdoor activities at their own risk. We strongly recommend that all clients obtain comprehensive travel insurance covering cancellation, medical emergencies, and personal accidents before travelling.
8. Photography and media
Funchal Tours may photograph or film tours for promotional use. If you do not wish to appear in such material, please let your guide know at the start of the tour. Clients grant Funchal Tours permission to use photographs or videos in which they appear incidentally for marketing purposes, unless they have opted out.
9. Governing law
These terms are governed by the laws of Portugal. Any disputes arising from a booking will be subject to the exclusive jurisdiction of the courts of Funchal, Madeira.
